A. VMT Website (www.vmtech.net) Usage
Personally Identifiable Information
VMT does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis, such as by registering with VMT. VMT shall maintain appropriate safeguards, consistent with the standards of the industry, to ensure the security, integrity and privacy of information collected from individuals.
Personally identifiable information collected by or on vmtech.net will not be sold or otherwise provided to third parties without user consent. In addition, at the time a user provides personally identifiable information, he or she will have the opportunity to indicate whether he or she would like to "opt out" of receiving promotional and/or marketing information about other products and services from VMT. Upon request, VMT will use reasonable efforts to allow users to update/correct personal information previously submitted which the user states is erroneous to the extent such activities will not compromise privacy or security interests. Also, upon a user's request, VMT will use commercially reasonable efforts to functionally delete the user and his or her personal information from its database; however, it may be impossible to delete a user's entry without some residual information because of backups and records of deletions.
Notwithstanding the foregoing, visitors are advised that aggregate statistics on visitors will be compiled by VMT and used to conduct market research. VMT may share anonymous, aggregate data with advertising, business or promotional partners. Notwithstanding any opt out of receiving promotional information by the user, VMT reserves the right to contact a subscriber regarding account status, changes to the subscriber agreement and other matters relevant to the underlying service and/or the information collected.
Disclosure of Information
VMT shall not disclose user information or the contents of e-mail received from visitors to vmtech.net except: (a) in the course of normal maintenance, operation and use of vmtech.net by and parties with whom it has contracted to provide certain services in connection with the site (e.g. the broadcasting of security alerts or updates) and its systems; (b) when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) VMT rights or property, other vmtech.net users, or anyone else that could be harmed by such activities; (c) as specified by the sender of such e-mail; (d) as required by law; or (e) as otherwise specified by Virtual Management Technologies on vmtech.net.
The foregoing policies are effective as of February, 2009. VMT reserves the right to change this policy at any time. This statement and the policies outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any party.
Notification of Policy Changes
Virtual Management Technologies complies with the U.S.-EU Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries. VMT has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. Virtual Management Technologies protects individually identifiable information as follows:
Virtual Management Technologies will not sell, trade, or disclose to third parties any individually (either client or VMT employee) identifiable information, derived from the use of any VMT service, (except as required by subpoena, search warrant or other legal process or in the case of imminent physical harm to the customer or others). When VMT uses other agents, contractors or companies to perform services on its behalf, VMT will ensure that the company protects the individually identifiable information consistent with this policy.
Virtual Management Technologies has implemented technology and security features and strict policy guidelines to safeguard the privacy of identifiable information from unauthorized access or improper use, and we will continue to enhance our security procedures as new technology becomes available.
The company will not read or disclose to third parties private e-mail communications that are transmitted using VMT services except as required to operate the service or as otherwise authorized by law.
Virtual Management Technologies may use individually identifiable information to investigate and help prevent potentially unlawful activity or activity that threatens the network or otherwise violates the customer agreement for that service.
Virtual Management Technologies honors requests from clients for changes in account information, such as name and password and will correct any such information that is inaccurate.
The United State Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions (FAQ) to enable U.S. companies to satisfy European Union (EU) law requirements for adequate protection of personal information transferred from the EEA to the United States. Virtual Management Technologies, Inc. adheres to the Safe Harbor Principles outlined below.
The privacy principles in this policy are based on the Safe Harbor Principles.
Notice and Choice:
Virtual Management Technologies does not collect personal information directly from individuals in the EU. Personal information may exist in e-discovery information that is provided to Virtual Management Technologies Inc, from an EEA organization for processing. To the extent permitted in the Safe Harbor Agreement, we reserve the right to process personal information in the course of providing managed services to our clients without the knowledge of individuals involved.
Onward Transfers and Disclosures to Agents:
Virtual Management Technologies will not knowingly disclose an individual’s personal information to third parties, except when one or more of the following conditions is true:
- We have the individual’s permission to make the disclosure.
- The disclosure is required by law or professional standards.
- The information in question is publicy available.
- The disclosure is reasonably necessary for the establishment or defense of legal claims.
Virtual Management Technologies takes data security seriously and has put in place appropriate physical, electronic, and procedures to safeguard and secure the information we process.
Virtual Management Technologies will use personal information only in ways that are compatible with the purposes for which it was collected, which is in the confines of e-discovery usage.
Upon request, Virtual Management Technologies will grant individuals reasonable access to personal information that it holds about them. In addition, VMT will take reasonable steps to permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete.
Virtual Management Technologies utilizes the self-assessment approach to assure its compliance with our privacy statement. VMT periodically verifies that the policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented, and in conformity with the Safe Harbor Principles.
